These Terms of Service ("Terms") govern your access to and use of OmahaConcreteLift.com (the "Site"), operated by Omaha Concrete Lift ("we," "us," or "our"). By using the Site or submitting a quote request, you agree to these Terms. If you do not agree, do not use the Site.

1. Nature of the Service

Omaha Concrete Lift is an independent referral and lead-generation website. We connect homeowners who submit project information with independent, third-party concrete leveling contractors who may serve their area (the "Service"). We are not a contractor. We do not perform concrete leveling, mudjacking, polyjacking, or any related construction, repair, or leveling work. We do not hold, and do not represent that we hold, any contractor license.

2. No Agency or Employment Relationship

Contractors contacted through the Service are independent businesses. Nothing in these Terms or in your use of the Site creates an employment, partnership, joint venture, or agency relationship between Omaha Concrete Lift and any contractor. Contractors are not our employees, agents, or representatives, and we do not direct, supervise, or control their work.

3. No Guarantee of Contractor Availability, Quality, or Pricing

• We do not guarantee that any contractor will contact you after you submit a request.
• We do not guarantee the availability, timeliness, quality, workmanship, pricing, or outcome of any work performed by any contractor.
• We do not guarantee that any contractor is licensed, bonded, or insured in your jurisdiction. Verifying a contractor's licensing, insurance, and standing is solely your responsibility.
• Quotes, timelines, warranties, and scopes of work are determined entirely by the contractor you engage, not by Omaha Concrete Lift.

4. Your Responsibilities

• Provide accurate and truthful information when submitting a quote request.
• Independently vet, verify licensing/insurance for, and negotiate directly with any contractor before agreeing to any work.
• Enter into any service agreement, contract, or payment arrangement directly with the contractor — Omaha Concrete Lift is not a party to that agreement.
• Direct any disputes about workmanship, pricing, scheduling, warranty, or payment to the contractor who performed or was engaged to perform the work, not to Omaha Concrete Lift.

5. Referral Compensation

We may receive compensation, such as a referral or lead-generation fee, from contractors in exchange for connecting them with your request. This does not affect the price you are quoted. Full details are available in our Referral Disclosure.

6. Intellectual Property

All content on the Site, including text, graphics, logos, and design, is owned by or licensed to Omaha Concrete Lift and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from Site content without our prior written permission, except for personal, non-commercial use.

7. Prohibited Uses

• Submitting false, fraudulent, or spam requests through the quote form.
• Attempting to interfere with, disrupt, or gain unauthorized access to the Site or its underlying systems.
• Scraping, harvesting, or misusing contractor or contact information obtained through the Site.
• Using the Site for any unlawful purpose or in violation of any applicable law or regulation.

8. Disclaimer of Warranties

THE SITE AND SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY CONTRACTOR MATCH WILL MEET YOUR EXPECTATIONS.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, OMAHA CONCRETE LIFT AND ITS OWNERS, OPERATORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE OR ANY INTERACTION WITH A CONTRACTOR OBTAINED THROUGH THE SITE, INCLUDING BUT NOT LIMITED TO DAMAGES RELATED TO WORKMANSHIP, PROPERTY DAMAGE, DELAYS, OR CONTRACT DISPUTES WITH A CONTRACTOR. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

10. Indemnification

You agree to indemnify and hold harmless Omaha Concrete Lift from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Site, your violation of these Terms, or any dispute between you and a contractor.

11. Third-Party Contractors

We do not warrant or guarantee the licensing, insurance, workmanship, or business practices of any contractor. Responsibility for verifying a contractor's licensing and insurance, and for any work performed, rests solely with that contractor and with you as the homeowner engaging them.

12. Governing Law

These Terms are governed by the laws of the State of Nebraska, without regard to its conflict-of-laws principles, unless otherwise required by applicable law.

13. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
